6. Service Management

Effective support of in-scope services is a result of maintaining consistent service levels. The following sections provide relevant details on service availability, monitoring of in-scope services, and related components.

  • Telephone Support: Monitored 9:00 A.M. to 6:00 P.M. Everyday.
  • Calls received outside of these hours will be forwarded to a mobile phone and best efforts will be made to answer or action the call; however, a backup messaging/voicemail service will apply.
  • Email Support: Monitored 9:00 A.M. to 5:00 P.M., Monday – Friday (excluding public holidays).
  • Emails received outside of these hours will be collected; however, no action can be guaranteed until the next working day.

6.2 Service Requests & Incident Response Times

In support of services outlined in this Agreement, the Provider will respond to service-related incidents and/or requests submitted by the Client within the following time frames:

  • High Priority — Within 0 to 8 hours (during business hours):
  • Any error which affects 2 or more modules from working properly; or
  • Any error which affects any core module used in the Client's day-to-day business operation, namely Point of Sale (POS), Cash Register, and Order Management.
  • Medium Priority — Within 48 hours:
  • Any error which impairs a non-core module from working properly.
  • Low Priority — Within 5 working days:
  • Any error, cosmetic issue, or general inquiry which does not hinder any module from working properly.

Remote assistance will be provided in line with the above timescales dependent on the priority of the support request.

7. Service Termination

Either Party may terminate the Agreement at any time upon 30 days' prior written notice to the other Party.

In the event the Client terminates the Agreement, the Client shall still remain obligated to pay the Provider for any Services performed up to the date of termination and any expenses approved, but not paid, prior to the date of termination.

In the event the Provider terminates the Agreement, the Provider shall reimburse the Client any amounts previously paid to the Provider for which the Provider has not yet performed the Services.

This Agreement will automatically terminate when both Parties have performed all of their obligations under the Agreement and all payments have been received.

7.1 Client's Data Upon Termination

The Provider will ensure the Client's data is available upon request for up to 3 months (90 days) after the termination date, after which the data will be permanently deleted from all of the Provider's servers and devices, whether in softcopy or hardcopy.
